Terms of Use

The sale of the Products is subject to the legal guarantees enshrined in the applicable laws, as well as other contractual guarantees that may be granted to the consumer.

The consumer must ensure that the ordered goods correspond to the order placed and that they do not suffer from manufacturing defects or apparent non-conformity.

In the event of a manufacturing defect or nonconformity of the Products, the Customer is entitled to demand that the conformity of the Product be restored through repair or replacement free of charge unless the requested conformity restoration option is objectively impossible or excessively burdensome compared to another conformity restoration option.

It is understood that the Customer forfeits this right if he does not notify FUTAH of the non-compliance of the Product within 2 months from the date the Customer discovered the defect.

To notify the existence of defects and non-conformities of the Product and to request that conformity be restored using the above options, Customers may contact FUTAH at hello@futah.world.

Any damage resulting from the use of the product or from failure to follow washing instructions will not be considered a defect or non-conformity.

Problems detected in the product that, in principle, do not fall within the scope of its production will be considered "manufacturing defects". Futah is a handmade product and therefore issues related to the handmade production process will not be considered defects.

Some Futah models have a very open cotton stitch. For this reason, even if you follow the washing instructions on the label, the Futah may reduce by about 5 cm in size. This will not be considered a defect since all the characteristics of the product are maintained.

At Futah we are committed to protecting your privacy. In order to complete a purchase on our site, you will need to give us some personal information. However, no information you give us will be shared with third parties or used for purposes other than those resulting from your business relationship with Futah.

There may be two types of order cancellations:

• At the request of the User Customer: The User Customer may cancel his order by requesting FUTAH to do so by e-mail, quoting the order number.
• By decision of FUTAH: FUTAH reserves the right not to process orders when it detects any inconsistency in the personal data submitted or observes misconduct on the part of the buyer.

All transactions on this online store are protected by Secure Sockers Layer (SSL) and Secure Data Encryption. This encryption process ensures that no one can decrypt your personal data as it travels from your computer to ours, and from ours to the bank's.

The User is committed to providing correct personal data and address. Suppose any of the data is incorrect or insufficient, and for this reason, there is a delay or impossibility in processing the order or eventual non-delivery. In that case, the responsibility is entirely the User, and FUTAH declines any responsibility. The costs of reshipping orders will be the responsibility of the customer.

The order of products must be made by users aged 18 years or older (individuals under this age will require authorization from their representatives). The elements and information transmitted by the client will enjoy the full legal effect, the client recognizes the electronic purchases, and may not allege the lack of signature for failure to comply with the obligations undertaken.

The Futah Online Store is a registered website and the Service provided by the website itself is the responsibility of FUTAH.

The User Customer acknowledges that the Service contains confidential information and is protected by copyright and related rights, industrial property and other applicable legislation.

The User Customer acknowledges that any content that appears in advertising, highlighting, promotion or mention of any sponsor or advertiser is protected by the laws relating to copyright and related rights, the laws relating to industrial property and other laws of property protection, so that any use of such content may only occur under the express authorization of the respective owners.

All price information, product specifications, promotions and services may be changed at any time by FUTAH.

All products and services sold in FUTAH Online Store are in accordance with Portuguese Law.

Data and information consultations made within the scope of this Service are assumed to have been consented to by the User, FUTAH declining any liability arising from the abusive or fraudulent use of the information obtained.

All prices on the site are in Euros.

Prices set on the website are the same  of the stores in Portugal, and they can change without notice.

Final prices of the products you ordered, will be the same that you see on the website, at the time of payment confirmation.

The price of the products will be as stipulated on our website, except in case of an obvious error. While we make every effort to ensure that the prices posted on the website are correct, errors may always exist. If we discover a price error we will inform the Customer and give the option to confirm the order with the correct price or cancel it. If the Customer can not be contacted, we will treat the request as canceled and all amounts paid will be refunded in full.
